Hi

Sajha Experts

My concern of creating the thread is related to going back to Nepal for 2 months and returning back in the safe way as per the immigration rules. I am in 7 months of OPT right now so it is impossible to go back right now.

I already finished my master's (MBA) here so is it ok to go to community college and use that I-20 to go to Nepal. What will be the chances in port of entry while returning? Further more, I am planning to file H1 in April and also joining the community college. So can I travel to Nepal after I file my H1 since I will have I-20 from community college. Since H1 results will come in average around October so by that time I will be back here.

Choices:

A: Getting I-20 from community college and file H1 in April and go back for two months.

B: Getting I-20 from University (But this would be a costly choice) too.

Please help me with the possible alternatives. Thanks a lot.

I think you should consult with others who have gone through the same scenario. May be that would help you out.

wolverine,

Sorry brother but it looks tough for you without getting H1b. You finished your masters and for your stamping purpose if you get an I-20 it has to be for your Doctorate program not CC. If you go to Nepal in OPT, OPT is not your stamp for re-entry. Your OPT expires if you leave the country. so its better you apply for H1b. If in case you get approved for H1b and the company which I am guessing will be a consultant company gives you the paper it is possible you can go back home as you will still be under the change of status and can go back home until October. but the safest bet is to work for atleast 2-3 months under H1b so that you can show that you can survive in the U.S.

Thanks local boy, that means there is no other way than H1 and H1 in this scenario is toughest than ever in the united states. If any friends have other alternatives let me know. Thanks a lot localboy.

The I-20 on which the OPT is endorsed should be valid until the end of the OPT period.  I know of people getting new F-1 visas issued valid until the end of the OPT period (and no later).  They did need a letter from their OPT employer, and demonstrate good reason for returning to the home country after the end of the OPT.
